The word "Apostille" is derived from the French and simply means notation or certification. Once a document has been notarially certified, some countries also require some further certification - an Apostille - which is essentially a small certificate issued by the Foreign & Commonwealth Office and attached to the document which verifies the signature and seal of the Notary Public in question. Spanish lawyers in particular often refer to this certificate as "an Apostille of the Hague" because the procedure is pursuant to "The Hague Convention of 5th October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents". Unfortunately, not all states are parties to this Convention and therefore documents for certain countries must be legalised firstly by certification of the Foreign & Commonwealth Office and secondly by the consulate of the particular state. The majority of notarial documents require prompt attention and the length of time required to deal with Apostilles and legalisation is often of concern to clients. The turnaround time of the Foreign & Commonwealth Office's Legalisation Department for postal applications varies depending upon time of year and volume of work. The various consulates also have differing turnaround times. In the case of very urgent matters it is often advisable to use the services of a legalisation agent who will attend in person at the Foreign & Commonwealth Office (and, if necessary, Embassy) and wait whilst the certification is added.
